Amendment of Terms & Conditions

AMENDMENT of the General Terms and Conditions for Individuals (version September 2011) and of the Terms and Conditions of Contract of the HSBC Internet Banking (Online Communication and E-Banking) service (version August 2011)

We, HSBC Bank plc (the Bank) hereby inform you that the maximum execution time of the payment transactions after the point in time of receipt as per the payment transactions in euro, the national payment transactions in the currency of the member state outside the euro area, provided that the currency conversion is carried out in the member state outside the euro area concerned and in case of cross border payment transactions, the cross boarder transfer takes place in euro from and to payment account in the European Union when the payment service providers are located in the European Union is amended.

According to law 3862/2010 (Government Gazette A 113/13.07.2010) on payment services our bank as payment service provider had the right to agree with the customer until January 1st, 2012 to credit to the payee's payment service provider's account the amount of the payment transaction within a period no longer than three business days.

Thus, in compliance with above law and the lapse of December 31st 2011 as from January 1st, 2012 after the point in time of receipt as per the payment transactions in euro, the national payment transactions in the currency of the member state outside the euro area, provided that the currency conversion is carried out in the member state outside the euro area concerned and in case of cross border payment transactions, the cross boarder transfer takes place in euro is amended from and to payment account in the European Union when the payment service providers are located in the European Union, the Bank is obliged to credit to the payee's payment service provider's account the amount of the payment transaction at the latest by the end of the next business day.

Therefore, the following terms of the General Terms and Conditions for Individuals (the Terms) are correspondingly amended:
5.3 of paragraph 5 'STATEMENTS' of Part II CONTRACT TERMS FOR THE ISSUANCE AND USE OF AN HSBC VISA DEBIT CARD
6.5 of paragraph 6. 'STATEMENTS' of Part III ISSUANCE OF CREDIT LIMITS – OVERDRAFT LIMITS section A. TERMS OF THE HSBC VISA (Classic / Gold) CREDIT CARD ISSUANCE AND USE CONTRACT'
Paragraph 'Maximum time for execution of payment instructions - Payment transactions to payment account and paragraph 'Refusal to execute payment instructions' of Part VII FRAMEWORK CONTRACT FOR PAYMENT SERVICES (PAYMENT TRANSACTIONS), section Ι. TRANSPARENCY OF TERMS AND INFORMATION REQUIREMENTS THAT GOVERN PAYMENT SERVICES and section II. RIGHTS AND OBLIGATIONS IN RELATION TO THE PROVISION AND USE OF PAYMENT SERVICES.

Also, the following paragraphs of the corresponding Sections of the Terms and Conditions of the Contract of the HSBC Internet Banking (Online communication and E-Banking) service (version August 2011) (the Contract) are amended:
The first paragraph of Section III. CUSTOMER REQUESTS FOR STATEMENTS AND FOR TRANSACTIONS ENTERED INTO USING THE SERVICE of the Contract and sixth paragraph of Section V. BANK'S RIGHTS AND OBLIGATIONS – BANK DISCLAIMER of the Contract.

The present consists an integral part of the Terms and the Contract.
